Further to the Answer of the Baroness Denton of Wakefield on 12th February (HL Deb. Cols. WA 32–34), whether it is the case that, although the Leicester Diocesan Board of Education was incorporated by the 1955 Measure, its powers were expressly confined by Section 1, subsection (1) of the 1955 Measure to "such rights, powers, duties and obligations as are vested in the Committee by this Measure" and did not extend to any power to acquire land or to be a trustee.

The Leicester Diocesan Board of Education was not incorporated under the Diocesan Education Committees Measure 1955 but under the Charitable Trustees Incorporation Act 1872. Under the 1872 Act, the diocesan board has been granted the power as trustees to hold and convey land.

The Diocesan Boards of Education Measure 1991 repealed the 1955 Measure. Under Section 2(2) of the 1991 Measure, the Leicester Diocesan Board of Education has the power to do all such things as are incidental or conducive to the discharge of its functions as set out under Section 2(1) of the 1991 Measure.
