asked Her Majesty's Government:

Whether it is the case that if infertility specialists are sued for negligence, they are unable to obtain legal advice or representation or submit a defence in a court of law without risk of prosecution; and, if so what steps are being taken to remedy the situation.

The Government recognise the concern, particularly among clinicians, about the unforeseen consequences of the confidentiality provisions in the Human Fertilisation and Embryology Act 1990. We are studying the position with great care with a view to finding a practicable solution.
