§ Mr. WaldegraveThe timetable for market-testing in my Department ensures that the whole programme listed in Cm. 2101 will be completed by 30 September 1993. Preparations to execute the programme are well in hand and the first market tests are expected to be completed early in the new year.

§ Mr. WaldegraveWhether or not the Transfer of Undertakings (Protection of Employment) Regulations 1981 and the EC acquired rights directive 77/189/EEC will apply to an individual case depends on the facts of that case. Departments will seek advice of legal advisers about the relevance of TUPE on a case-by-case basis, as has been the case in the past.
