To ask the Secretary of State for the Environment what regulations exist for the control of the burning of chlorine or PVC-based waste; and what agency is responsible for the implementation of such controls.

The control of existing plant burning chlorine or PVC-based waste is presently subject to the following regulations:

  • The Collection and Disposal of Waste Regulations 1988.
  • The Control of Industrial Air Pollution (Registration of Works) Regulations 1989.

The Collection and Disposal of Waste Regulations are enforced by waste disposal authorities. The Control of Industrial Air Pollution Regulations are enforced by Her Majesty's inspectorate of pollution.

Since 1 April 1991, new incinerator plant for these wastes has been subject to the Environmental Protection (Prescribed Processes and Substances) Regulations 1991, enforced by either HMIP or local authorities depending on the exact nature of the waste and the capacity of the incinerator. Existing incinerators will progressively be brought under these controls.
