To ask the Secretary of State for the Environment (1) what representations he has received from the Association of District Councils on the effectiveness of current legislation in enabling the control of development with particular reference to development which constitutes a departure from the structure plan;

(2) what advice he gives to local planning authorities when they are considering applications which involve development which constitutes a departure from the structure plan.

No such representations have been received. A local planning authority which is considering a planning application that involves development constituting a departure from the structure plan should follow the procedures in the Town and Country Planning (Development Plans) (England) Direction 1981. Advice is given to authorities in Department of the Environment circular 2/81.
