To ask the Secretary of State for Scotland what advice he gives to those local authorities which wish to include planning gain policies in their local plans; and if he will make a statement.

The Scottish Development Department issued a circular to local authorities on planning gain in August 1984—circular 22/84. The circular provides authorities with guidance on the circumstances in which they might reasonably seek an agreement with a developer under section 50 of the Town and Country Planning (Scotland) Act 1972 and on the inclusion in development plans of policies on the use of such agreements.
