To ask the Secretary of State for Scotland if he has considered the terms of transfers of employment currently being offered by Scottish Enterprise to Training Agency staff; whether these meet the terms of guarantee given; and if he will make a statement.

My right hon. Friend approves, in conjunction with Her Majesty's Treasury, certain specific aspects of the terms of employment which will apply to Scottish Enterprise staff. It is a matter for Scottish Enterprise itself to ensure that the terms of individual offers of employment, taken as a whole, comply with paragraph 16(3) of schedule 1 to the Enterprise and New Towns (Scotland) Act 1990. The 1990 Act provides for any dispute as to whether the terms of paragraph 16(3) have been complied with to be resolved by an industrial tribunal and this is not, therefore, a matter for my right hon. Friend's consideration.
