To ask the Secretary of State for the Environment if he will set out those areas of corporate information on pollution that will be excluded from deposition in the local register on grounds of commercial confidentiality.

It is not possible to define exhaustively the areas of information which should be excluded on grounds of commercial confidentiality. Under section 22 of the Environmental Protection Act 1990, the onus is on the operator to prove to the enforcing authority that disclosure of information would prejudice to an unreasonable degree their commercial interests—and every case will have to be considered on its merits.
