To ask the Secretary of State for Health if he will name any health service trust which has introduced its own terms or conditions of service since the passing of the National Health Service and Community Care Act 1990; and if he will list those powers which would enable any provider organisation to take such steps(a) with his consent and (b) without his consent.

Information about the terms and conditions of service of staff in NHS trusts is not collected centrally. All provider units are subject to certain powers governing the employment of staff. For NHS trusts, these are set out in sections 5, 6 and 7 of schedule 2 to the National Health Service and Community Care Act 1990. For staff in other provider units, including those staff transferred to NHS trusts who chose to remain on their contracts of employment on transfer, the powers are paragraph 10(1) of schedule 5 to the National Health Service Act 1977, paragraph 11 of schedule 3 to that Act and the National Health Service (Remuneration and Conditions of Service) Regulations 1991 (SI 1991 No. 481).
