asked Her Majesty's Government:

Following the last two sentences of the Answer of the Earl Ferrers on 15th July (WA1) whether, prior to his answer, the order had already been established on 22nd May 1991 by the Secretary of State for Education by Statutory Instrument 1991 No. 1254; and whether that order contained any provision by which the managing trusteeship of the charity passed from the Vicar and Churchwardens to Leicester Diocesan Board of Finance; and, if so, whether they will specify the provision and the statutory authority for it.

The Statutory Instrument (S.I. 1991/1254) was made by the Secretary of State for Education and Science on 22nd May 1991. The order was therefore made prior to the Answer of the Earl Ferrers on 15th July (WA1). The order appoints the Leicester Diocesan Board of Education as new trustee of the Barkestone School Foundation by virtue of Section 2(6) of the Education Act 1973.
