asked Her Majesty's Government:

Whether the Secretary of State for Education on 22nd May 1991 made a statutory instrument (SI 1991 1254) purporting to authorise the sale of the premises and land of the Barkestone School and to remove the trustees thereof, and if that instrument is valid, what steps the Secretary of State and the diocesan authority can take in order to enforce it, and whether they intend to take those steps.

The statutory instrument (SI 1991/1254) made by the Secretary of State for Education and Science on 22nd May 1991 appoints the Leicester Diocesan Board of Education as new trustee of the foundation known as Barkestone Church of England School and authorises the diocesan board, as trustee, to sell any of the property of the foundation. The Secretary of State is satisfied that the instrument is valid. The diocesan board, as trustee, is free to exercise any of the powers conferred on it by the order or by general law.
