Mr. Rooker

To ask the Secretary of State for Social Security for what reason his Department is not paying severe disability premium to Mr. D. Wilkes of Perry Barr, Birmingham, awarded by the social security appeal tribunal on 8 January 1991, Ref. 401: 33475.

Miss Widdecombe

The severe disability premium is not being paid to Mr. Wilkes because the chief adjudication officer is appealing to the social security commissioner against the social security appeal tribunal's decision. Under regulation 37 of the Social Security (Claims and Payment) Regulations 1987 the award is not implemented pending the outcome of this appeal.

The severe disability premium is not being paid to Miss Hunt because the chief adjudication officer is appealing to the social security commissioner against the social security appeal tribunal's decision. Under regulation 37 of the Social Security (Claims and Payment) Regulations 1987 the award is not being implemented pending the outcome of this appeal.
