To ask the Secretary of State for Social Security if he will investigate the delay in the consideration by the Social Security Commissioners in the determination of the appeal submitted on 2 June 1990 regarding the decision and the basis of the decision by a medical appeal tribunal recommending the application for mobility allowance for a constituent of the late hon. Member for Neath (Mr. Coleman) residing in Ystalyfera.

The Office of the Social Security Commissioners (OSSC) received an application for leave to appeal on behalf of the claimant, now deceased, on 7 June 1990. On 22 June, the appellant was asked to submit to the OSSC, in keeping with the requirements of regulation 4 of the Social Security Commissioners Procedures Regulations 1987, a copy of the ruling signed by the chairman of the Medical Appeal Tribunal refusing or granting leave to appeal. On 27 June, a duplicate application for leave to appeal was received from the appellant's solicitors who were promptly informed of the need to supply the required document.

The appellant's solicitors have been given a further opportunity to submit a copy of the tribunal chairman's ruling before a commissioner determines the application.
