HC Deb 27 February 1991 vol 186 cc503-4W
Sir Eldon Griffiths

To ask the Secretary of State for Employment what steps are open to a claimant before an industrial tribunal to obtain compensation where a decision of the tribunal in his favour has proved to be incapable of enforcement; and if he will make a statement in the case of Mr. Darren Read, case No. 3417/90.

Mr. Forth

In England and Wales an industrial tribunal decision generally has to be enforced through the county court. Where the tribunal awards a statutory redundancy payment which the employer fails to pay, the payment will be made by my Department. If the employer is formally insolvent certain debts, including a basic award for unfair dismissal and holiday pay, may also be paid by my Department. I shall be replying shortly to the letter which my hon. Friend recently sent the Department about the case of Mr. Read.
