Mr. Maginnis

To ask the Secretary of State for Northern Ireland if he will publish details of the evidence that Daniel Doherty, who was shot dead by the security services at Gransha hospital in Londonderry on 6 December 1984 was, at that time, engaged in a terrorist operation.

Dr. Mawhinney

[holding answer 5 December 1991]: It is not the practice to publish details of police investigations. The death of Daniel Doherty was fully investigated by the RUC, and the report passed to the Director of Public Prosecutions, who directed "no prosecution" of the soldiers involved.

However, I believe that it is widely accepted that Daniel Doherty was engaged in terrorist activities when he was killed.
