To ask the Secretary of State for the Environment how many successful prosecutions have been made since 1974 for breaches of waste disposal licences not directly connected with the deposit or treatment of waste; and if he will make a statement.

Mr. Baldry

By the end of 1989, there had been a total of 897 prosecutions under sections 3 and 6 of the Control of Pollution Act 1974 which may involve breach of a waste disposal licence. More detailed information about the precise nature of the offences is not held centrally.

To ask the Secretary of State for the Environment if all waste disposal sites in the United Kingdom currently meet both the 1975 EC waste directive and 1978 EC toxic and dangerous waste directive; and if he will make a statement.

These directives require, inter alia, site-specific permits for the disposal of controlled waste and consignment notes for the movement of dangerous or difficult waste. They have been implemented in Great Britain by the Control of Pollution Act 1974, the Control of Pollution (Special Waste) Regulations 1980, the Environmental Protection Act 1990, the Town and Country Planning (Assessment of Environmental Effects) Regulations 1988, the Environmental Assessment (Scotland) Regulations 1988, the Town and Country Planning Act 1990 and the Town and Country Planning Act (Scotland) 1972.

In Northern Ireland, they have been implemented by the Pollution Control and Local Government (Northern Ireland) Order 1978, the Pollution Control (Special Waste) Regulations (Northern Ireland) 1981, the Planning (Assessment of Environmental Effects) Regulations (NI) 1989 and the Planning (Northern Ireland) Order 1991.
