HC Deb 08 May 1990 vol 172 cc118-9W
Mr. Nicholas Bennett

To ask the Secretary of State for Defence on what occasions since 1960 his Department has initiated an application under the planning laws and subsequently claimed Crown immunity to overide an adverse planning decision; and if he will make a statement.

Mr. Alan Clark

None. My Department follows the planning procedures as laid down in the appropriate DOE, Scottish Office and Welsh Office circulars. Where the local planning authority concerned raises objections to an application for development by my Department, it would be for my right hon. Friend the Secretary of State for Defence to decide whether or not to refer that proposal to the Secretary of State for the Environment, the Secretary of State for Scotland or the Secretary of State for Wales, as appropriate.
