Whether foodstuff manufacturers are, in law, liable to purchasers of their products in respect of the wholesomeness of the products they offer for sale when the ingredients are not specifically listed.

Under Clause 8 of the Food Safety Bill currently before Parliament, any person who sells for human consumption, offers or has in his possession for the purpose of such sale any foodstuff (with or without an ingredients list) which fails to comply with food safety requirements would be guilty of an offence. Food safety requirements cover food which has been rendered injurious to health, or is unfit for human consumption, or is so contaminated that it would not be reasonable for it to be used in that state for human consumption. The requirements apply to manufacturers, wholesalers and retailers.
