HL Deb 23 January 1990 vol 514 c1047WA
Lord O'Hagan

asked Her Majesty's Government:

What advice they would give to British charities which are concerned about European Community legislation on toy safety to which the Government have agreed.

The Minister of State, Department of Trade and Industry (Lord Trefgarne)

The Toys (Safety) Regulations 1989, which implement the EC directive on the safety of toys, apply to all toys supplied for the first time, in the course of a business, after 1st January 1990. If toys are supplied to raise money for charity in the course of a business they must comply with the regulations. However, toys made and given, for example, to a local church or association for sale at an annual fete are unlikely to be supplied in the course of a business and therefore the regulations would not apply.
