§ Mr. TrippierCrown immunity for hospital incinerators with a capacity of over 1 tonne an hour was lifted in March 1989 as a result of the Health and Safety (Emissions into the Atmosphere) (Amendment) Regulations 1989. Clause 54 of the National Health Service and Community Care Bill provides for a widespread removal of Crown immunity from National Health Service premises. This will cover all National Health Service incinerators. The provision will be brought into effect by commencement order at the earliest opportunity.
