To ask the Secretary of State for Trade and Industry whether he will state the nature of any legal proceedings under way, outstanding or stayed by a judge in the High Court which have been brought by his Department against either British Aerospace or Rover.

On 10 September, HMG served writs on Rover Group and British Aerospace to secure the repayment with interest of, respectively, £1.5 million and £42.9 million which had been ruled by the Commission to be unauthorised concessions in connection with the sale of Rover Group to British Aerospace. On 29 November British Aerospace and Rover Group made a successful application to the court for a stay in these proceedings pending the outcome of their application to the European Court of Justice to annul the Commission's requirement to repay.
