§ Mr. LilleyNo. In all privatisations the Government observe the Transfer of Undertakings (Protection of Employment) Regulations 1981 (TUPE), which provide that, where there is a transfer of an undertaking, all the employees' rights and liabilities must automatically be transferred to the new employer. Pension rights fall outside the scope of TUPE and are negotiated separately in each case.
