§ Mr. MallonTo ask the Secretary of State for Northern Ireland if he will make a statement on the present state of investigation by the police and the independent Police Complaints Commission into the circumstances in which Seamus Duffy was killed by a police plastic baton round in Belfast on 9 August.
§ Mr. CopeThe police investigation into the circumstances surrounding the death of Seamus Duffy is being actively pursued and has reached an advanced stage. The investigation is being closely monitored by the Independent Commission for Police Complaints for Northern Ireland. Once the investigation has been completed the investigating officer's final report will go to the Commission which will then issue a statement to the chief constable on the conduct of the investigation. The papers will then be passed to the Director of Public Prosecutions. Until such time as the DPP has issued directions on the case, or any proceedings have terminated, it would not be appropriate to give details of the investigations.
