To ask the Secretary of State for Health if registered homes tribunals have a right to impose additional categories of registration in addition to those which relate to the number of residents and their age, sex or category.

In a recent case (Warwickshire county council v Valerie McSweeney (1988)) the High Court held that a registered homes tribunal's power to impose conditions in respect of a registration for a residential care home is limited to those cases set out in section 5(3) of the Registered Homes Act 1984—that is, as to the total number of residents and their age, sex or category. Decisions of the High Court arising from an appeal on a point of law are binding on subsequent registered homes tribunals.
