Mr. Nicholas Bennett

To ask the Secretary of State for Home Department if he will set out in theOfficial Report the current powers of a police officer to stop and require a member of the public to give his name and address.

Mr. Douglas Hogg

Unless the police have reasonable grounds to suspect that a person is committing or has committed a criminal offence they can stop him and require him to give his name and address only if he is the driver of a motor vehicle (under the Road Traffic Act 1972) or arriving at a port (under the Prevention of Terrorism (Supplementary Temporary Provisions) Order 1984 and its Northern Ireland equivalent).
