To ask the Secretary of State for the Environment under what statutory enactment an individual is obliged to apply to the local planning authority for permission to erect a satellite dish on a private dwelling house.

Class H of part 1 of schedule 2 to the Town and Country Planning General Development Order 1988 grants permission to install a single satellite antenna on or within the curtilage of a dwellinghouse provided the antenna's maximum diameter does not exceed 90 cm and it does not project above the highest part of the house's roof. Otherwise, specific planning permission is necessary under section 23(1) of the Town and Country Planning Act 1971.
