To ask the Attorney-General if any instructions have been given to the Crown Prosecution Service on the prosecution of persons formally charged under section 47 of the Offences Against the Person Act.

The Attorney-General

No specific instructions concerning the prosecution of offences under section 47 of the Offences Against the Person Act 1861 have been issued to the Crown Prosecution Service as a whole. However, some chief Crown prosecutors have issued guidance to Crown prosecutors in their area.

As with all cases prosecuted by the service, in accordance with the code for Crown prosecutors, Crown prosecutors are required to satisfy themselves that there is sufficient evidence to afford a realistic prospect of conviction, and, if there is, whether the public interest requires a prosecution, before continuing criminal proceedings for such offences.
