HC Deb 27 April 1989 vol 151 cc654-5W
Mr. Shersby

To ask the Secretary of State for the Environment what particulars he has specified in relation to the provision of section 61(A)(7) of the Town and Country Planning Act 1971 concerning the need for district councils to keep a register of trees in conservation areas.

Mrs. Virginia Bottomley

Section 61(A)(7) of the Town and Country Planning Act 1971 places a duty on district and London borough councils to compile and keep available for inspection a register of notices served on the council of intention to carry out work on trees in conservation areas, where such trees are not already protected by tree preservation orders or otherwise exempt. It also empowers the Secretary of State to determine what particulars should be included in such registers. The following matters were specified for this purpose in DOE circular 36/78:

  1. (a) the address of the land on which the tree stands and sufficient information to identify the tree;
  2. (b) details of the work proposed.
