To ask the Secretary of State for Scotland if he will bring forward proposals for legislation with regard to dog fouling to enable local authorities and police to take action against irresponsible behaviour on the part of dog owners.

It is already an offence under section 48 of the Civic Government (Scotland) Act 1982 for a person in charge of a dog to allow it to foul any of the places specified in that section. The Act is under review, and proposals for improvements in its provisions will shortly be the subject of consultation.
