To ask the Secretary of State for Transport if he will indicate the nature of the topics that require resolution prior to his publications of draft legislation to replace the Public Utilities Street Works Act 1950; and what timetable he envisages in resolving problems still outstanding between representatives of the interests principally concerned.

Work is substantially complete on the substance of the legislative proposals. Final decisions have still to be taken on the question of diversions of utilities apparatus consequential on highway works, and the related balance of liability as between the highway authority and utility. I hope that these matters can be resolved within the next few weeks.

Detailed drafting will be necessary before the terms of a Bill can be finalised. Submission of a Bill will depend on finding a suitable opportunity for it.
