Mr. John Hughes

To ask the Secretary of State for the Home Department when, and for what reason, Mr. Paul Cleeland was transferred from prison to Moss Side hospital.

Mr. Cleeland was transferred to Moss Side hospital under section 47 of the Mental Health Act 1983 on 18 March 1987. This followed the receipt of reports from two qualified medical practitioners that he was suffering from mental illness of a nature and degree which made it appropriate for him to be detained in a hospital for treatment.

To ask the Secretary of State for the Home Department if he will consider using his powers under section 50(1) of the Mental Health Act 1983 to recall Mr. Paul Cleeland from Moss Side on the grounds that no effective treatment for his disorder can be given in that hospital.

My right hon. Friend can consider remitting Mr. Cleeland to prison under these powers only if the responsible medical officer notifies him either that Mr. Cleeland no longer requires treatment in hospital for mental disorder or that no effective treatment for his disorder can be given at Moss Side hospital.
