To ask the Secretary of State for the Environment if he has any plans to review the established use certificate procedure.

In the recent report of an efficiency scrutiny of planning enforcement notice appeals, the repeal of the provisions (in section 94 of the Town and Country Planning Act 1971) for issuing established use certificates, after a prior notice period of two years, is recommended. The report of the efficiency scrutiny, and my Department's action plan in response to it, are about to be published. This recommendation requires further study, and we shall consult interested organisations and professional bodies about the recommendation and its likely consequences.
