To ask the Secretry of State for Employment whether prosecutions are to be undertaken against the owners of Penlee quarry, Newlyn, Penzance, following the accident on 28 January, 1987; and if he will make a statement.

Mr. Nicholls

No. The circumstances as identified by the investigation gave no grounds for the institution of prosecution proceedings against the owners.

To ask the Secretary of State for Employment how many visits were made during the five years prior to 1987 by a mines and quarries inspector to Penlee quarry, Newlyn; what changes were required; how many were carried out; how many improvement or prohibition notices were issued; and if he will make a statement.

Mr. Nicholls

There were 11 visits made to Penlee quarry in the five years prior to 1987. There were no prohibition or improvement notices issued. There were 25 recommendations made by mines and quarries inspectors during this period and these were acted upon by management.
