To ask the Secretary of State for Employment whether he will list the grounds for withdrawal of benefit under the availability for work test.

Mr. Lee

The requirement that a person be available for work is a fundamental condition for the receipt of unemployment benefits. It was re-enacted most recently in the Social Security Act 1975.

The condition means that a person must be available for work with an employer and must not restrict their job-seeking, in terms of the hours, days, pay, location or type of employment they are willing to accept, to such an extent that they effectively have no reasonable prospect of securing work within those restrictions.

To ask the Secretary of State for Employment what plans he has to extend the application of the availability for work test.

I refer the hon. Member to the reply given by my right hon. Friend the Secretary of State to my hon. Friend the Member for Bristol, North-West (Mr. Stern),Official Report, Monday 14 December, at columns 337–38. This is an area which I shall continue to keep under review.
