What criteria are used when the decision is taken whether or not to prosecute for evasion of television licence duty.

Such decisions are matters within the discretion of the Post Office, having regard to all the relevant circumstances of the case, save that proceedings may not be instituted without the prior approval of the Secretary of State for the Home Department where the alleged offender:

  1. (a) has been given incorrect official advice about his licensing requirement; or
  2. (b) is living in extreme poverty and is either aged over 70 or is chronically sick or disabled; or
  3. (c) appears to be seriously mentally disordered.
