To ask the Secretary of State for the Environment whether, following the loss of trees through the hurricane, he has any plans to review tree preservation orders in the south of England.

Reviewing, and where appropriate varying, individual tree preservation orders is the responsibility of the local planning authority. The Department is undertaking a wide-ranging review of tree preservation legislation and procedures, and this will take into account the implications of the losses of trees in last autumn's storm. In addition, as I said in the Adjournment debate on March 22, our intention is to take prompt action to remedy the specific problem that now exists following the judgment of the Court of Appeal in the case of Bellv. Canterbury city council.
