To ask the Secretary of State for the Environment if in the light of the recent decision of the Court of Appeal, he has plans to introduce legislation to protect councils from claims for compensation from developers in relation to the effect of tree preservation orders, where the proposed development lies outside the Town and Country Planning Acts.

I understand that the local planning authority concerned are considering whether to petition the House of Lords for leave to appeal against the decision of the Court of Appeal. Until the judicial process is complete in would be inappropriate for me to comment on this issue, but we are keeping in touch with developments.
