To ask the Secretary of State for the Environment what representations he has received seeking an explanation of the different treatment of swinging moorings, as defined in the new schedule on Non-Domestic Rating: Exemption to the Local Government Finance Bill, and mooring between piles and in marinas; and what response he has sent.

I have received one such representation. The Bill, as amended, preserves the existing exemption from rating for "swinging" moorings consisting of a buoy attached to a weight or anchor. Permanent moorings, including those in marinas or between piles, will continue to be rated unless they are used for a boat which is someone's sole or main residence.
