To ask the Secretary of State for Education and Science what provision will be made for circumstances where, under the terms of the Education Reform Bill, local authorities become liable to pay compensation or legal costs where governors of schools with financial delegation have in good faith contravened statutory or contractual requirements, including the provisions of the Race Relations, Sex Discrimination and Employment Protection Acts, and collective agreements with trades unions.

In so far as such costs relate to dismissal of staff, the Bill provides that the local education authority shall meet them outside the school's delegated budget unless it has good reason for deducting them from that budget. For other cases it would be a matter to be settled as part of the operation of schemes of financial delegation whether such costs were to be met outside the school's delegated budget or could be deducted from that budget.
