To ask the Secretary of State for Health if he has any plans to remove Crown immunity from hospital incinerators and boiler plants.

The National Health Service no longer has Crown immunity from the Health and Safety at Work etc Act 1974 which includes provisions bearing on the operation of incinerators and boiler houses. New controls on incinerator emissions were proposed in the consultation paper "Air Pollution Control in Great Britain", issued in December 1986. A best practical means standard for the application of the controls to NHS incinerators is currently in preparation for inclusion in regulations which are expected to be made in 1989. We are not proposing that the National Health Service should have Crown immunity from these regulations.
