To ask the Secretary of State for Scotland what steps are being taken to improve availability in Scotland of an effective judicial remedy for a number of individuals with similar complaints against a common defender.

The Scottish Law Commission has agreed to accept a formal reference from my noble and learned Friend the Lord Advocate under section 3(1)(e) of the Law Commission Act 1965, in the following terms:

  1. a. To consider the desirability and feasibility of introducing in Scottish civil court proceedings arrangements to provide a more effective remedy in situations where a number of persons have the same or similar rights;
  2. b. to consider how such arrangements might be funded; and
  3. c. to make recommendations.
