To ask the Secretary of State for Social Services if he will reconsider the case of Dr. Raj Kumar and his claim under the National Health Service (Superannuation) (War Service Etc.) Regulations 1977; and if he will consider future amendment of these regulations.

Dr. Kumar's claim to reckon his war service in the National Health Service superannuation scheme has been most carefully considered but cannot be met. The National Health Service (Superannuation) (War Service Etc.) Regulations 1977 require that entry to National Health Service employment, following war service, must have been on or before 30 June 1950. Dr. Kumar did not enter such employment until 17 September 1976 and so does not satisfy this requirement. There is no discretion under the war service regulations to vary the basic entry requirements. These have been applied consistently not only to the NHS superannuation scheme but to all other public service schemes.

The Government do not intend to amend these regulations.
