To ask the Attorney-General what is his policy towards the prosecution of those who publicise sketches of court proceedings in contravention of section 41 of the Criminal Justice Act 1925; and if he has any proposals to allow them in circumstances most likely to ensure their accuracy.

The Attorney-General

Sketches of court proceeding made with a view to publication are prohibited by section 41 of the Criminal Justice Act 1925 only if made in court. Where such an offence is alleged, the Crown Prosecution Service will prosecute if there is sufficient evidence and if it would be in the public interest to do so. The criteria it will apply are those made public by the Director of Public Prosecutions in his code for Crown prosecutors.
