79. Mr. Dykes

To ask the Secretary of State for the Environment if he is contemplating new guidelines and instructions for inspectors hearing appeals against the refusal of planning permission in the future.

Mr. Chope

A new planning policy guidance note on local plans was published on 30 November. The note stresses the importance of formally adopted and up-to-date local plans which are consistent with national and regional policies and with the relevant provisions of the structure plan. The note indicates that where there is such a plan, together with properly substantiated reasons for the local authority's decisions, my right hon. Friend and his inspectors will be guided by it in dealing with planning appeals.

Inspectors will take this new advice into account, along with other material considerations, in hearing appeals.

Mr. Porter

To ask the Secretary of State for the Environment when he proposes to use the powers granted to him in the Housing and Planning Act 1986 to enable appellants who prosecute planning appeals by means of written representations or local hearings to be awarded costs against an unreasonable local authority.

Mr. Chope

My right hon. Friend has no present plans to bring these powers into operation, but the matter is being kept under review.
