To ask the Secretary of State for the Environment if he will make a statement on his proposals to amend section 53 of the Wildlife and Countryside Act 1981 following the decision in the case of Rubinstein and another v. Secretary of State for the Environment.

Our intention is to introduce legislation, when a suitable opportunity occurs, to return to the situation that was assumed to exist prior to the judgment in the Rubinstein case. This will enable surveying authorities, on the discovery of evidence, to make orders correcting mistakes in the recording of rights of way on the definitive map.
