To ask the Secretary of State for Transport what instructions his Department gives to deter those working on the repair or maintenance of the United Kingdom motorway system from running across the motorway lanes in front of oncoming traffic; whether he is satisfied that those instructions are adequately enforced; and whether he has received any representations on this subject.

Under the Health and Safety at Work, etc. Act 1974 the health, safety and welfare at work of employees and their supervision is the responsibility of each employer. In addition, it is the duty of every employee while at work to take care for the safety of himself and others.

Enforcement of the Health and Safety at Work, etc. Act is the responsibility of the Health and Safety Executive.

Advice on this subject in relation to trunk roads and motorways is given in a departmental advice note TA 2/79 and in a joint report published in 1985 by the Department and the County Surveyors' Society. A copy of each has been placed in the Library.
