To ask the Minister of Agriculture, Fisheries and Food if he will seek to amend the Food Act 1984 to enable local authorities to revoke the registration of a mobile food hawker who in the opinion of the local authority causes a nuisance to the population in the area in which he operates; and if he will make a statement.

I have been asked to reply.

Officials have been asked to consult interested organisations to consider revision of the Food Act 1984. However, registration of food hawkers by local authorities under that Act is concerned solely with food hygiene.

Local authorities have general powers to deal with nuisances under part III of the Public Health Act 1936 if they consider that the activities of any trade or business are prejudicial to the health of, or a nuisance to, inhabitants of the neighbourhood.
