§ Mr. RentonThere is no provision in the Immigration Act for illegal entrants to apply for bail but under schedule 2 to the Act an illegal entrant may be granted temporary release from detention. The criteria applied are whether the illegal entrant will comply with any conditions attached as to residence or reporting and whether there are any compassionate circumstances.
