Mr. Bermingham

asked the Secretary of State for the Home Department what is the normal procedure with regard to extending the residence period granted to a person likely to be imprisoned for political reasons on return to his own country, on application, after an initial grant of 12 months' residence has lapsed; and what were the considerations made in the case of Mr. Safpar Hamdani, overseas co-ordinator to the Pakistan People's Party, currently in London.

An individual in this position would normally be granted leave to remain for an initial period of one year and then be granted further leave to remain for a period of three years, after which permanent settlement may be granted. Further leave to remain may however be granted for shorter periods than three years where, for example, there is a possibility of a change in the circumstances which led to the initial grant of leave to remain. The normal criteria have been applied in the case of Mr. Safpar Hamdani.
