HL Deb 14 July 1987 vol 488 c1027WA
Lord Hylton

asked Her Majesty's Government:

Whether consideration is given in Belfast or in London, to applications under the Northern Ireland Emergency Provisions Acts for alleged offences to be "certified out" for jury trial; from whom advice is received and what further enquiries are made, particularly when refusal is recommended.

The Lord Chancellor (Lord Havers)

The Attorney General usually considers these applications in London but he sometimes considers them in Belfast when he is visiting Northern Ireland. The Attorney General bases his consideration upon relevant facts and circumstances relating to the offence placed before him by the Director of Public Prosecutions for Northern Ireland. If the Attorney General in any instance considers that he needs further information, this is sought by means of appropriate enquiries pursued by the director, the results of which are placed before the Attorney General by the director.
